Dominic M - Royal Arabians Collection Fee Agreement

Mare Owner (as listed below) has purchased one or more breedings to Dominic M, through Royal Arabians, LLC. Mare Owner understands that Orrion Farms is not taking on the obligations of Royal Arabians under any such agreement, but is only assisting by providing semen to Dominic M.

Mare Owner understands and agrees:

Orrion Farms will be satisfying the Breeding Contracts by providing cooled semen.
Mare Owner will pay the costs identified on this form for the collection and shipment of the cooled semen.
Mare Owner must obtain from Royal Arabians all transported semen certificates and other documents necessary to register the resulting foal(s).
The breeding season for Dominic M is from February 1 to August 1, and shipments will be made only on Monday, Wednesday and Friday of each week. Variations from these policies are at the discretion of Orrion Farms.
Orrion Farms must receive 24 hour notice for semen shipments.
Orrion Farms shall provide semen from Stallion to Mare Owner and makes no other guarantee of the condition of the semen.
Semen is delivered on a first come, first serve basis and is subject to Stallion’s schedule and commitments. The Stallion shall be collected no more than once a day. Semen shall be available for purpose of semen transport only if the quantity requested for transport is on hand. Mare Owner expressly acknowledges that all orders for semen are subject to delay.

The terms and conditions in this agreement shall apply to and bind the parties stated herein. This contract shall be construed and governed by the laws of Arizona. The Arizona courts shall have exclusive jurisdiction to hear and determine all suits, actions, or proceedings and to settle all disputes arising in connection with this agreement and for such purposes, each party irrevocably submits to the exclusive jurisdiction of the Arizona courts.

Mare Owner agrees that Orrion Farms and its subsidiaries, affiliates, agents, employees, veterinarians and farriers shall not be liable for any damages, losses or injuries arising out of or connected with any services or products provided to Mare Owner by Orrion Farms, except as required by law. Mare Owner fully understands, authorizes, and assumes the special risks inherent in breeding, and acknowledges that mortality and other insurance is solely the Mare Owner’s responsibility. All implied warranties, including fitness, merchantability or otherwise, and all special, incidental and consequential damages are hereby excluded, to the full extent permitted by law. In no event shall Mare Owner’s remedy exceed the amount paid for the service complained of.
